If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.

We are applying for my husband's H4 extension now. ( My new H1b extension was approved only till Sept 25, 2009 based on the SOW( client contract) rather than 3 years)So he would be able to get his extention same as me Sept 25, 2009.
We have also applied for my husband's H1b this year. Hopefully, if his H1b is approved
1. Does he has to go outside US to get his visa stamped to start working from Oct 1, as there is no status for him from Sept 26 through Sept 30 ( 5 days)
2. If we apply for his H4 extension along with my H1b extension during early Sept and he will remain in status as the Case will be pending, Does it allow him to start working on H1b without needing to stamp?

My employer says that he is going to run the taxes from the state where the company is located and not from the state where I'm actually working.
Says something changed on the company's front and the CPA advised that there won't be any problem .He's giving me all kinds of reasons about how he can't run the taxes from my state and says there won't be any problem in 485 stage.
If called for the 485 interview we may have to bring our pay stubs to the interview .In that case would there be any problem with this scenario.?
By the way the address I have on file for all my applications is another state (different from where I'm living and where my company is located).(If) called for an interview I guess it will be in the state which is on my applications . Does any one know if I'm right?
Please let me know if this fine.

My I-94 extension (for L1B visa) was denied on Oct '08 and I returned in 4 days after they updated Denial status. Reason for denail is "lack of specialized knowledge". I am planning to apply for L1B again in next month (By showing additional certification). Can you please advice me
- is it fine to apply for visa again as it will be more then 6 months after it was denied
- Do I need to show the copy of denial notice during visa interview? Is there any thread available providing suggestions for those applying for visa again after it was denied earlier...

Hi,
My OPT was approved and I received the approval notice. But the card itself
has been lost in mail. I have applied for a replacement card.
I am aware of something called the "I-9 receipt rule" wherein the receipt for
the replacement of a lost document can be used in place of the document itself
for a period of 90 days.
Does this apply to my case? In other words, can I use the receipt of the replacement
request to work for upto 90 days?

In US from Feb 2000 - till date
PD :Aug 2002
I140 approved on Aug 2004 (no rfe)
I485 rcpt :sep 2005 pending for approval...
worked with Company A and 2002,2003 w2's are way too low 9k and 25k. Went to home country for vacation 3 times on 2004, 2005.
my 2000,2001, 2004,2005,2006 till looks okie.. I dont have any other overstay or other issue.
Applied I485 on
2005. I guess my attorney filed my 2003 w2 with my i485 petion.
I chaged from company A to company B on 2005
Will im in trouble? UN or somebody can please help?

At the time of granting Green Card, USCIS may RFE request for evidence. What exactly do they need me to provde, in particular when AC21 is involved?
Just employment letters? Or do they need pay stubs from the NEW employer as well? Then only the most recent paycheck or the whole history of payroll information with the NEW employer?
Appreciate your help.
In my case, I-140 was approved, and I-485 submitted over 180 days. Then I plan to invoke AC21 working for a new employer with similar job.

People, I see my RD, ND , A#, name on my I485 receipt. But I don't see my priority date PD mentioned on it. I am worried that this might delay my case processing. Anyone in the same boat as me

I work for Employer A (who holds my H1) and I have an approved I-140 from Employer B, I-485 pending. Am due for H1B renewal this Dec, can I use my I-140 Approval (done from Employer B) to get 3 year extension when Employer A applies ?

My attorney filed I-140 on July 5th. No receipt yet. No news also.
He said he cannot send it to TSC, instead he mailed it to NSC. Is that the standard filing place?

Hi,
Based on what I know, the medical exam has to be less than 1 year old on the date of I-485 application submission. However, I have seen different opinions on this forum. Some state that the exam date cannot be more than 30 days before I-485 submission, because the HIV test and syphyllis test (sorry if not typed correctly) are valid for 30 days only. Could anyone clarify this, please?
