Hi,
I am currently on STEM OPT and have lost my job. I have an offer from Company A but they are not willing to enroll into the eVerify system. To bypass this, they suggested that I take up employment with a consulting firm B (who is enrolled in eVerify) and then work on company A's project as a contractor through firm B. Would this be legally OK? I heard that even though I would be on company B's payroll, company A should still be registered with eVerify.
Can someone please advice on what is the legal requirement??

I am starting my employment based GC process. My employer is going to file for my labour certificate (LC) thru PERM soon.
However, I want to know what happens if you Labour Application is not approved by USCIS?
like - Can you then apply for Labour thru another employer? or start ur Green Card process thru another employer.
- Can you get H1 extension after 6 year period is complete?
Kindly advice.

I think if she didn't indicate that she intended to do CP in her I-140, but rather indicated she intended to do AOS in the US, then it will be a pain in the neck to switch to CP

I have a certain labor category approved 19-#### and AOS is applied . Now the job I am looking at moving to has the same number (19-####) but the job duties are not exactly same. Will this be OK for AC21 or will I have problems?

I am here on L2 and then Joined a Company in 2006. When I joined, that time the H1 Cap 2007 was already over so my company said that they will do my H1 this year. Unfortunatly I got the H1 Rejected as my case couldnt get in the lottery.
In the Mean time my company have filed my Green card under EB3 and we have I-140 Approved (1 st stage) in August 07.
Now, is there any way that anyone can Help me?

Hi All,
I am in EB3 with priority date of 2003 nov, I have a masters degree in US. Because of my negligence I applied in eb3. my i140 is cleared in eb3. waiting for priority date. Now I am planning to file eb2 perm and make us of the old priority date. Before joining for work I completed all the course work but didnt get the degree. I got the degree one year after I joined for work. My graduation date in the degree certificate is 5 months after my priority date. Will this raise red flags in the eb2 I-140 stage. Would it be safer for me to go for regular i-140 or premium processing. Any help or suggestion will be deeply appreciated.

I am trying to get an infopass to check my I-485 status
1. After selecting "you need information or other services" in the infopass process, The infopass is not showing me any appointment dates, instead it is showing "At this time, there are no information appointments available for the office in your area. Please try back again later."
I have done infopass before 6 months ago, and it showed me the date to select but now it is now doing that. just the message "At this time, there are no information appointments available for the office in your area. Please try back again later."
Does anyone faced the same issue and help me to get an infopass!

I need an advice.
I was in US since Apr 1999. FIled for GC in oct 2000. I got my I-140 approved.But then i had to go back to india as my company transferred me to india office in Oct 2001.
I left that company in jan 2004 and joined another company in india. Then in July 2004 i came back to US thru a consulting firm. An din jan 2005 my client offered a job. So since Jan 2005 i am working at the cients office as their employee. I filed for LC in Sep 2005, it got approved in oct 2005 (Just mised by 3 weeks)
My question is was was it possible to use the PD from my previous GC. which is Oct 2000.My atternoy told me it is not possible. But i saw similer posting on IV, hence i am curious. Also if possible is there any way i can get the old GC at this stage,my I-140 is approved this time too.,

I want to transfer my H1-b from a consultant company to a non-profilt organization which is offering me a full time job. I haven't resigned my job at consultant company yet. The LCA process is going on with new non-profilt organisation and then they are going to apply for H-1B petition soon. I am worried if the consultant company will cancel my visa as soon as I resign and that would cause issues for the H-1b transfer. Please advice when is it safe time to resign and start my new job.
