Dear Attorney,
I am on L1B visa and valid until Oct2010; I somehow decide to apply for green card with certain personal reason.
As I understanding, the employer will file the green card petition for me. I'd like to what's the difference between filing from lawyer ("Duration"), because I am ready to hire a lawyer to file that for myself if it can shorten the duration to obtain a green card. What's the time range it will be processed from L1B to greencard?
My only concern is if it is a shortcut (duration) to file green card petition from lawyer instead of employer.
Looking forward your clarification.

Hi Guys:
My wife is out of country from October 2010. She was working on H1B. After birth of our son, she went to India for 6 month vacation. Will there be any issues if she re-enters US using H1B as she is having a job to continue with her employer.
What are all the documents I need to take.
Please advice.

u cannever get that kind of stuff done even with ur phone company... Changing address is kind of banned in any US system....

Hi guys, How can i find out processing times for I290 B on I140 denial from Texas service center.
My appeal for Motion to reopen (Appeal to Commissioner) reached them on 1/25/08 and I saw LUD on 2/1/08.

However, no one was prepared for today's announcement from the State Department that most of the family-based categories will retrogress between one and three years beginning on January 1, 2011. Consider the worldwide categories: Beginning in January 1, the 1st preference category (unmarried sons and daughters of U.S. citizens) goes from a 5-year to a 6-year wait. The story is much, much worse in the 2A category (spouses and children of permanent residents) where the wait expands from a mere 4 months to 3 years, a 9-fold increase....

"The check or money order should be made payable to the Department of
Homeland Security except:
--If you live in the U.S. Virgin Islands and are filing this
application freely, make your check or money order
payable to the ''Commissioner of Finance of the Virgin
Islands.''
--If you live in Guam and are filing this application there,
make your check or money order payable to the
''Treasurer, Guam.''
Good luck in re-filing!

once 140 is approved, one can port the PD. Doesn't matter whether it was LC SUB or not. My personal understanding, check with a lawyer.
However this practice is long gone (discontinued since second quarter of 2007) and no more LC SUB is allowed.
I am wondering, I assume that you must have done this prior to second quarter of 2007, then you may have also filed 485 based on this 140.

I first off apologize if there is already a thread pertaining to my questions. If so I would greatly appreciate being directed.
My situation is this...I came to the US as a visitor from Canada. As a result I did not need a I-94, a visa or a passport since i travelled by car. I am going to be married to a US citizen in a couple of weeks. I guess my questions are these...#1. Since I did not need any of those documents to enter the US, will this cause a problem while trying to prove status?
#2. I read somewhere about filing a I-30 prior to other documentation such as the I-485 and medical and so on. I was wondering if this is true or if i even need to file this document or if so if it can be filed in conjunction with the others.

I am kind of confused. For UK visitors visa after I fill in the application forms do I need to go to a center to do my biometric. I am opting to submit the forms in person at the chicago center ...is the biometrics thing will be done during the submission at chicago..?

b) the existence of ImmigrationVoice.org to fight this evil
The NJ team has taken the initiative to make more people aware of the situation our organization. As part of this initiative, the NJ team will be distributing flyers to visitors of the Bridgewater temple today starting at 11.30 am.
If you would like to participate in activities like this, please feel free to start a thread for your state/district and other volunteers can pitch in

While we all sit and wait in this painful 485 retrogression, I am just wondering, what if the retrogression pulls on past the 3 year extension (attained after the initial 6 years and I140 approval).
I have my perm LC/I140 approved/485 retrogressed with a PD of Feb 2006.
Being EB2 and starting my 7/8/9 years in early 2007, I am a bit unlikely to hit that scenerio, but someone like me in EB3 is very likely to hit that scenerio...
Does anyone know, what happens after 9 years on H1 and not able to file 485 due to retrogression??

Hi,
I have changed to a new employer using AC-21 recently. I have pro-actively sent AC-21 documentation (new offer of employment, covering letter and supporting docs) to USCIS. Ever since, I am checking my case online. Its about 3 months now that I have sent this info and there has not been any update/LUD on my 485 case so far. I am not sure if my I-485 case has details about my new employment.
I am currently doing my EAD renewal. I am thinking if it will be possible to indicate to USCIS about my new employment. Can you please advice on -
a) if it is wise to do so?
b) How can it be done?
