I have worked for Company "A"(Ex-employer) under H1-B(company A holding my H1-b) from 2007-2010. During 2009 & 2010, company A was unable to clear all my payments as the company went through some financial hurdles but they issued W-2 for the amount paid in fiscal year 2009. Now, company A has got money and they decided to clear my back wages for 2009-2010 through 1099 form. I transferred my H1-B visa to Company B(2010) then to Company C(current employer). Now, Company C has started my Green card(GC) process.
Questions:
1. I already received W2 for 2009. Can company A amend the W2 for the back wages?
2. Is it legal to take the unpaid amount under 1099? Will it affect my GC process?
3. What are my options to get my back wages from company A?
4. Company A want to issue 1099 along with a letter stating that i was full time employee for the time period mentioned in 1099. Is it acceptable?
I really appreciate your help for taking your valuable time in clarifying my questions. I look forward for your reply.

I got my 140 approved and my 6 yr H1 gets over in Jan 2010.
Could someone tell me whn is the earliest I can apply for my 3 yr extension??
And is there a time period before you have to apply for the extension?

Can someone confirm if 1 year of OPT training also counts towards work experience? My friend needs to know since he needs to apply for Labor Certification and wanted to find out if this experience can be counted apart from the H1-B working experience.

USCIS has announced that for the third week in a row, the H-1B count sits at 45,000 out of 65,000 used. Besides importing new H1s, the best way to increase the number of professionals in a pool of "Talent for hire for the highest bidder" is to free up half a million existing H1bs from their bond with current jobs by speeding up their greencard.

I sent my I-485 application to USCIS on July 31, 2007. On their website they logged the following message:
"Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Case received and pending.
On September 24, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case....."
Why is the received date Sep 24, 2007 when the application was most likely received on Aug 1, 2007?

As well we can tell them that probably we may not arrived yet to launch a life changing product,the moment we arrive there, WE promise that we may never talk about immigration specially EB-reforms.
Yes, with out a backup up of big institutions(this case MIT) this dream or idea would have just lived like any wish or it would have taken 3 or 4 times longer.

Hello,
If you have a valid dual purpose visa like H-1B, then you don't need AP to reenter US, but if your visa has expired, then you must hold AP to reenter the US. EAD is work authorization (which allows you to pursue employment without restrictions inside US), but it is not a travel authorization.

My wife switched from H4 to F1 status and is near completion of her Masters degree.
She will be traveling to India soon and will be getting her F1 visa stamped.

For my 9th year H1-B visa extension, i want to use the premium processing. All the attorney fee and any other expenses will be paid by my company. I want to pay only the $1000 for premium processing. Is this legal ? Can the attorney attach my $1000 check signed by me, to the visa extension application with all other paperwork and send it to BCIS ?
If this is not legal what are my options ?

Hi
I am working on H1B from Oct 2009. My employer and client has one layer between of them. For some family reason I need to visit India for 10 days. Will it cause any problem / Issue on airport (immigration counter) when I will come back to USA ?
In this case how can I prepare myself to face situation? What documents do I need to prepare to prove that even though I am working with one layer then also my employer control my salary and tax stuffs ?
